Brian C. Bosma was recently selected by his peers for inclusion in The Best Lawyers in America 2018 for Closely Held Companies and Family Business Law. This is Mr. Bosma’s first recognition by Best Lawyers in this field. With an extensive background in engineering, business, law and government, Mr. Bosma’s practice is concentrated in the areas of complex business and municipal transactions, municipal finance and environmental matters. He chairs the Business and Government Practice Groups of Kroger Gardis & Regas, and serves as general or special counsel to dozens of municipalities and business entities throughout the State of Indiana.
An engineering graduate of Purdue University, Mr. Bosma represents both public and private sector clients in real estate and construction projects, public sector joint ventures and redevelopment matters.
Representative Bosma has served as a member of the Indiana House of Representatives since 1986 in numerous leadership capacities, including currently serving as the Speaker of the House since 2010. Mr. Bosma is a founding director of Bosma Industries for the Blind and serves as the Chairman of the Bosma Visionary Opportunities Foundation.
This marks the tenth year that Jay Kennedy was selected by his peers for inclusion in The Best Lawyers in America 2018. Jay was recognized in three categories: Banking and Finance Law; Bankruptcy and Creditor Debtor Rights / Insolvency and Reorganization Law; and Litigation – Banking and Finance.
Jay concentrates his practice in the areas of commercial litigation, creditors’ rights, agricultural law, secured transactions, commercial and CMBS foreclosure, and bankruptcy matters. He is a frequent author on bankruptcy and commercial litigation matters. Mr. Kennedy generally represents lenders in restructuring of secured obligations, state and federal court foreclosure of real and personal property assets, and recovery of collateral in bankruptcy proceedings. He also represents bankruptcy trustees and court appointed receivers, and both prosecutes and defends bankruptcy preference and other avoidance actions in Indiana and throughout the Midwest.
Jay recently completed training the 40 hour training to become registered as a civil mediator pursuant to Indiana Alternative Dispute Resolution Rule 2.5(A) and looks forward to apply his extensive knowledge as a mediator.
Jay is a 1979 graduate of Emory University and received his J.D. from Indiana University School of Law, Indianapolis, in 1982. He is a past president of the Brebeuf Jesuit Dads Club and served on the Board of Directors of The Orchard School.
Madalyn Kinsey was included among The Best Lawyers in America 2018 for Banking & Finance Law, marking the thirteenth year she has received this honor. She focuses her practice in the representation of banks and financial institutions in middle-market lending, commercial real estate lending, floor plan financings, asset-based lending, and loan restructurings. With almost forty years of legal experience, she has practiced in Indiana, Illinois, and California.
Before joining Kroger, Gardis & Regas, Madalyn was Vice President, Senior Counsel, and Manager at JPMorgan Chase Bank (formerly Bank One), and Senior Counsel with Bank of America in its Chicago and San Francisco offices. Since 2005 she has been named a “Super Lawyer” by Indianapolis Monthly in Banking & Finance. She is the State Chair of the American College of Mortgage Attorneys, and has taught Advanced Business Law at Indiana University for several years.
Madalyn has served on the Board of Managers of the Indianapolis Bar Foundation, and is past Chair of the Business Law Section of the Indianapolis Bar Association (IBA) and a past-Treasurer of the IBA.
Jim Knauer has been recognized for the thirtieth year by his peers and selected for inclusion in The Best Lawyers in America 2018. Jim was recognized in two categories: Bankruptcy and Creditor Debtor Rights / Insolvency and Reorganization Law; and Litigation – Bankruptcy.
He has represented secured and unsecured creditors, receiver’s, bankruptcy trustees, creditor’s committees and business debtors in many of the most significant business insolvency and bankruptcy cases that have been filed in Indiana during the past 30 years.
He has substantial experience in all aspects of business transaction and business litigation, including environmental matters, shareholder litigation; business fraud; secured creditor enforcement; guaranty litigation; RICO actions; lender liability defense and class action representation; and non-compete covenants.
Jim has served on the Editorial Board of Bankruptcy Law and Litigation Report, was a member of the Panel of Trustees for the United States Bankruptcy Court, Southern District of Indiana, Indianapolis Division, 1979-1987; and is a past member of the board of directors of the Indiana Association for Corporate Renewal.
He was inducted in 2008 as a Fellow into the Litigation Counsel of America, a trial lawyer honorary consisting of less than one-half of one per cent of American lawyers. Jim is a 1968 graduate of Indiana University (Bloomington) and received his J.D. in 1971.
James Lauck was included in the 2018 Edition of The Best Lawyers in America for Banking & Finance Law and Litigation – Banking & Finance. Extensive experience and a background in commercial and residential real estate have established and focused Mr. Lauck’s practice in the areas of practical solutions to lenders in the collection of debt secured by real estate.
Overseeing a real estate foreclosure group at Kroger, Gardis & Regas, LLP, Mr. Lauck has resolved state court cases in nearly every county in the State of Indiana, as well as bankruptcy and district court cases in all divisions, north and south. Broadening his background in these areas, Mr. Lauck has been a frequent seminar speaker and author on commercial and residential foreclosures, bankruptcy creditor rights and collections. He has served in the past on the Plat Committee for the Metropolitan Development Commission, City of Indianapolis.
Mr. Lauck was a member of the Indiana Horse Racing Commission from 2004-2013 and now serves them as an Administrative Law Judge. Mr. Lauck’s education includes a J.D. from the Indiana University McKinney School of Law and a B.B.A. from the University of Notre Dame, both degrees earned with honors.
David Wright was selected for inclusion in The Best Lawyers in America 2018 in the field of Corporate Compliance Law. Mr. Wright has extensive experience in business-related litigation, in trial courts, and in arbitration. Mr. Wright has served as lead counsel in litigating cases involving novel and complex issues relating to banking, corporations, minority shareholder oppression, partnerships, employment, professional liability, trusts, estates and fiduciary issues. Mr. Wright has been a speaker and author on arbitration, foreclosure, shareholder disputes, minority shareholder claims, and lender liability.
He is a Distinguished Fellow of the Indianapolis Bar Foundation, a member of the Indiana Trial Lawyers Association, The Association of Trial Lawyers of America and the Litigation Counsel of America Trial Lawyers Honor Society. He is President of the Board of the White Star Endowment, Inc.
