Indiana adopted its Rules for Alternative Dispute Resolution (ADR) in 1991 providing for intensive training and registration of ADR mediators. Likewise, Indiana courts and the clerk for the United States Bankruptcy Court, have established panels of mediators. KGR attorneys include neutrals trained and registered as Indiana mediators and members of various court panels including the Bankruptcy Court panel. In addition, our attorneys serve as environmental dispute mediators through panels which approve only attorneys extensively experienced in this area.
Our attorneys serve as arbitrators in a wide variety of matters including sports doping, construction, and civil litigation disputes. Our attorneys have been approved as arbitrators by the American Arbitration Association, the International Court of Arbitration for Sport (CAS), and other governing bodies while working extensively with the AAA arbitration rules in both construction matters and civil dispute resolutions.
Dispute resolution not only includes mediation of claims between parties, but can also be useful in reaching agreements within the litigation itself including discovery matters. Electronic discovery (E-Discovery) is a particularly complex area and newly revised Federal Rules of Civil Procedure can provide for extensive sanctions in cases where parties do not comply with the rules. Litigation dispute mediation can be an effective method of avoiding these sanctions and other costs by reaching agreement between the parties as to what E-Discovery is required while narrowing the burdens and costs to each of the parties.
