KGR Represents Paula Copenhaver Before the Indiana Recount Commission

May 19, 2026 //  by KGR

KGR has partnered with Paula Copenhaver in petitioning the Indiana Recount Commission for an election challenge and manual recount in the 2026 Senate District 23 Republican Primary that resulted in a two-vote loss to incumbent State Senator Spencer Deery.

2026 Republican Primary Election Results in Indiana Senate District 23 Challenged

Indianapolis, IN – Kroger, Gardis & Regas, LLP (KGR) attorneys Bill Bock, Ted Nolting, and Sarah Pfister filed a petition for recount and election contest before the Indiana Recount Commission on behalf of State Senate District 23 Candidate Paula Copenhaver to contest the primary election in Indiana State Senate District 23. The race for the Republican nomination to represent District 23 in the Indiana State Senate went down to the wire. As of May 18, the unofficial tally on the website of the Indiana Election Division shows Paula Copenhaver just two votes behind incumbent State Senator Spencer Deery, with nearly 13,000 votes cast. Copenhaver’s petition seeks a manual recount of all votes cast in the Republican Primary in Indiana State Senate

Petition Claims Evidence of Election Tampering

Copenhaver’s petition asserts that there “is substantial evidence of tampering with the 2026 Republican Primary Election in Senate District 23 by individuals not entitled to vote in the Republican Primary pursuant to Indiana Code § 3-10-1-6, and the extent of such tampering is sufficient to have likely affected the outcome of the election.” The petition identifies fourteen (14) individuals who appear to have crossed over party lines to vote in the Republican Primary in violation of Indiana law and urges the Indiana Recount Commission to enforce Indiana Code § 3-10-1-6 and not count invalid votes in conducting the recount in Indiana Senate District 23. A copy of Copenhaver’s Petition for Recount and Election Contest can be viewed in its entirety below.
